US EPA proposes Reporting and Recordkeeping Requirements for Nanoscale Materials

The Environment Protection Agency of the United States of America (US EPA) published a proposed rule for section 8 (a) of the Toxic Substances Control Act (TSCA). This proposal would introduce reporting and recordkeeping requirements for nanoscale materials as well as a 135-days pre-notification requirement for the manufacturers of ‘chemical substances as discrete nanoscale materials’.

The EPA proposes that companies that manufacture or process chemical substances as nanoscale materials notify the Agency of:

  • 'certain information, including specific chemical identity;
  • production volume;
  • methods of manufacture; processing, use, exposure, and release information; and,
  • available health and safety data.'

To support this proposed rule, US EPA released a fact sheet, available following this link.

This proposed rule will be published on 6 April 2015, opening a 90 days consultation period.
