California Regulators now interested in silver, iron and ceria

Following a mandatory data call-in on carbon nanotubes, and the expression of a similar interest in ‘reactive metal oxides’,  the California Department of Toxic Substances Control (DTSC/Department) has now updated its website with an announcement that the following materials have been added to the list of nanomaterials of interest:

  • nano silver
  • nano zerovalent iron, and  
  • cerium oxide’

CA DTSC maintains that ‘[the] announcement of intent does not represent a formal information request. The Department seeks the voluntary early engagement with "manufacturers" and/or submission of information to help shape further steps in the process.  We seek input from all levels; from nanomaterial manufacturing to use in final products.  The Department welcomes any comments or suggestions regarding which nanomaterial or nanometal oxides should be included in our review.’

The responsible CA DTSC official, Dr Jeff Wong, said during an NIA-event on ‘Nanomaterial Data Call-Ins and their Regulatory and Enforcement Implications’, held in Washington DC on the 15th April 2009 in collaboration with McKenna Long & Aldridge, that the CA DTSC website announcement followed a specific Departments-internal regulatory ‘Code’.

Following the data call-in on carbon nanotubes, initiated through the publication of a letter on the 22nd January 2009, the Californian Department of Toxic Substances Control (DTSC) has now widened its information request. (13th April 2009)
 
On the 22nd January 2009, the California Department of Toxic Substances Control (DTSC/Department) published a letter announcing that the Department required ‘information regarding analytical test methods, fate and transport in the environment, and other relevant information from manufacturers of carbon nanotubes.’ The letter explains that ‘the term "manufacturers” includes persons and businesses that produce in California or import carbon nanotubes into California for sale.’ (27th January 2009)
